The AP is seeking an experienced counsel to support our growing digital news business. The position will provide data privacy guidance and transactional support to our consumer-facing news outlets. This is a unique, newly created position ideal for a candidate who thrives working across disciplines, is passionate about privacy, and knowledgeable about the digital advertising ecosystem.


We are looking for a savvy business partner and excellent communicator who is equally comfortable educating Product and Technology leaders on the quickly evolving privacy regulatory space and negotiating agreements with major advertisers, agencies and ad tech providers.


Reporting to the Assistant General Counsel, you will be the go-to legal support person for AP’s growing digital media business and will have the opportunity to help shape an exciting and growing part of our business.  The Corporate Counsel, Digital Media and Privacy will assess AP’s current data privacy & governance practices against current law and best practices and build a roadmap that supports the business and technology goals of the organization.


Responsibilities:

  • Provide legal support to AP’s consumer news business, with a focus on privacy, advertising and digital media.
  • Work closely with the Assistant General Counsel to define, implement and maintain a privacy management program in support of AP’s digital news business.
  • Lead the development and refinement of privacy documentation (privacy policies, data processing agreements, etc.).
  • Provide legal advice to internal stakeholders on applicable laws, regulations, contractual obligations, and industry best practices.
  • Negotiate agreements with advertisers, consultants, media agencies, ad tech providers, business partners, and vendors.
  • Provide legal support and guidance for cross-platform advertising, sponsorship and content marketing campaigns.
  • Track new and upcoming privacy/data security legislation to help analyze and communicate the implications of changing U.S. and international laws.
  • Manage and negotiate commercial transactions, including content and technology license transactions, strategic partnerships and alliances. 
  • Establish policies and processes for conducting privacy impact assessments, managing data subject access and deletion requests and other privacy related activities.
  • Educate business clients and other stakeholders on relevant privacy regulations and industry best practices.
  • Serve as subject matter expert on consumer data privacy matters.
  • Collaborate with Technology and Product Teams on incident preparedness, investigation, communication, and remediation, including acting as one of the main points of contact on incidents involving potential data disclosure and security breaches.
  • Work with Product and Technology teams to define technology needs to support privacy management program.
  • Assist with other company privacy initiatives as needed.

 

Qualifications:

  • JD and 5+ years’ experience in the areas of advertising, media and privacy (ideally including law firm and in-house experience), with 2+ years emphasis on privacy.
  • CIPP certification a plus.
  • Good working knowledge of US and global privacy regulations, including GDPR, UK GDPR, CPRA and other existing and emerging global and US federal and state laws. 
  • Strong understanding of online publishing and advertising, including familiarity with industry standards and best practices, including IAB standard terms 3.0, IAB Limited Service Provider Agreement, DAA Self-Regulatory Principles, NAI tools, etc.
  • Understanding of intellectual property in the context of digital media.
  • Preference for experience in developing and implementing a comprehensive privacy management program for a digital business, publisher preferred.
  • Familiarity with major tech platforms and ability to navigate relevant platform and privacy terms.
  • Deep understanding of current and emerging data privacy regulations and trends.
  • Experience working with privacy management technology solutions. 
  • Ability to work independently, proactively and cross-functionally.
  • Ability to assess risk and provide workable solutions to business clients.
  • Ability to develop and maintain privacy compliance processes, practices, documentation, and education.
  • Excellent verbal and written communication skills. Must be a persuasive speaker and presenter.

Location: 

Preference is for this position to be remote or based at AP headquarters in NYC.  

 

Advanced-level professional competency in written and spoken English language is required.  Authorization to work in the US for any employer is mandatory.

 

The anticipated salary range for this position is $170,000 - $180,000, contingent on experience and other job-related factors.  Employees are eligible to participate, according to the terms of the official plan documents, in a 401(k) plan, employer-sponsored health insurance plan, and are eligible for paid time off and holidays in accordance with AP policy.
